"The electronic commerce (e-commerce) is covering a significant part of legal researches recently. Researching in this area is growing very fast because the size of business transaction electronically is enormous and it is a fresh and interested subject. One of the main and important types of e-commerce is electronic auction. In this type of auction, a trader post goods on one of the official auction websites and bidders or buyers bid and react to price increases electronically. The parties do not meet face to face and the contract takes place on distance. Thus, it is not easy for consumer to know seller’s personality; financial capability of vendor regarding implementing terms of the contract and goodwill of implementation and singeing of the contract.
In the research, we suggested several recommendations including amendment of Iraqi consumer law and encouraging electronic commerce. We also invite Iraqi legislator to enact a law for organizing electronic auction. This law should provide legal protection for online consumers as well as face-to-face consumers."
