Abstract


Recently, neurological disorder so-called autistic disorder widely spread among children, which shows symptoms from the first three years of a child’s life, and stays with him throughout life. So that his nervous system is disturbed, which is reflected in the shortcomings from the psychological, cognitive, linguistic, visual and social aspects. Moreover, as they grow and mature in the future, their sexual and physical drive requires marriage and the establishment of a married life. Because some of them remain in the category of people with special needs, he needs social care. If he has a family and gets married, it reduces the fears of his parents after their death that their son or daughter will remain without care and attention. Therefore, there must be a legal regulation for the marriage contract of these people and how to dissolve it in terms of law and sharia, according to the degree of severity of the symptoms of the disorder and his health condition. We aim through this study a statement of our most important proposal to the Iraqi and Kurdish legislators to fill the legal gaps in the texts and provisions related to marriage and divorce this oppressed group in society maintenance of their rights in the future.
