Abstract

The legislator in Geneva Law Consolidated (1930-1931) and trade legislations which is quoted provisions of this law, including the Iraqi Trade law amendment No. (30) for the year (1984), Deal unjustified duplication by counting date endorsement bill of exchange as voluntary data that can be overlooked, at the time making a statement creation date bill of exchange compulsory  consequent overlooked invalidity bill of exchange, as the significance of the date (endorsement, creation) almost do not differ in thing in both cases.

However, the date of endorsement is not compulsory  in law, but once you put it must be true not interpolated otherwise be face moot problematic in date endorsement and legal circumstances that accompanied as though Endorser put earlier date endorsement or delay it for real history. 

Therefore, we chose the study of ” date endorsement bill of exchange between the voluntary and compulsory” according to the analytical method through two parts: In the first part we dealt with the optional and realism in the inclusion of date endorsement, while In the second part we dealt with the problematic date endorsement .

Finally we offered the conclusions and recommendations and the most important of which claim the Iraqi and internationally legislature by making a statement date endorsement compulsory to avoid legal and real problems as we have dealt with over the course of this research.
