Abstract

The absence or weakness of the legal means available to ensure that the judicial verdicts against the administration are respected and that the administration is forced to implement these provisions have led the comparative systems, especially the French system, to find more serious means to ensure the implementation of the judicial decisions. and to force them to implement the decisions against them when they fail to implement those provisions, and perhaps the aggravation of the crises due to the intransigence of the administration and the failure to implement the provisions against them, so as to push countries to seek solutions to force the administration to implement. The keenness on the success of the administrative judiciary in Iraq and the Kurdistan Region - Iraq, which is modern relative to the experiences of other countries have made us highlight the weaknesses or points that helped to make the problem of non-implementation of administrative provisions issued against management is exacerbated and become a phenomenon is widely spread, and In order to improve the role of administrative judiciary in Iraq and the Kurdistan Region - Iraq in the field of protection of individual rights and freedoms, we highlight the implementation of many legislative reforms towards the need to respect the authoritative administrative judgments issued against the administration by implementing them and providing adequate legal means.
