Abstract

After 2003, private security companies appeared in the Kurdistan Region – Iraq. Despite the presence of a number of private security companies already operating, there was no special law issued by the Kurdistan Parliament regulating the work of these companies in the region, but these companies were managed under the Coalition Provisional Authority Memorandum (dissolved) No. (17) of 2004 regarding registration requirements for private security companies, as well as regulations from the Ministry of Interior to the Kurdistan Regional government to organize their work. However, due to the dissolution of the Coalition Provisional Authority in June 2004 and the non-issuance of the law to enforce the (2004) Memorandum by the Parliament of the Kurdistan Region - Iraq, the (2004) Memorandum did not constitute a clear and strong legal basis for determining the status of private security companies and organizing their activities in the Kurdistan Region of Iraq, Therefore, the Law of Private Security Companies in the Kurdistan Region - Iraq No. (18) of 2021 was issued, concerning the work of these companies in the Kurdistan Region, but what is noticed in this law is that it is shrouded in a lot of ambiguity and does not address some issues related to private security companies. Accordingly, we chose to conduct this research to clarify our observations about the law itself and to indicate our suggestions in order to address its shortcomings and ambiguities.
