Abstract


The legislator has granted res judicata to the criminal judgments in front of the civil courts. According to this, civil courts must be abided to what is judged by the criminal courts in the incidents that are a common reason to both the criminal and the civil lawsuit. This is for avoiding contradictory judgments in the same incident. and no one can hold on to res judicata unless certain terms are available, furthermore it is not given to all the criminal judgments but only some of them. Thus we have customized this study to indicate the terms of working of res judicata in front of the civil courts, and its scope.
