Abstract


This study examines the idea of how to find and Ensure Constitutional Justice in Iraq, in the light of the Constitution and relevant laws. This is based on the study of the role of the Constitutional Judiciary in ensuring constitutional justice, but at a very critical period in the Legal and Political life of Iraq, the period following the invasion of Iraq, after 9/4/2003, The most important of the stakes put forward by the Federal Supreme Court in the face of constitutional violations to protect the sanctity of the provisions of the Iraqi Constitution of 2005, although the establishment of the Federal Supreme Court was outside the constitutional framework, the study is based on how to contribute to the decisions and judgments of the Federal Supreme Court to establish a building Constitutional in Iraq, and Which is influenced by the decisions of the Federal Supreme Court to ensure adherence to the Constitution (the force) which is established outside its frameworks and rules, and is now in the process of ensuring compliance with it; This study also examines the rules and principles adopted by the Federal Supreme Court to ensure the dedication of the Constitution, and to ensure the competence of the public authorities and their mutual cooperation under the existing system of government in Iraq, the parliamentary system, on the other; Finally, this study focuses on highlighting the role of mechanisms adopted by the Federal Supreme Court to link decisions and the environment in which these decisions are issued, Which the Court faces under that environment.
