Abstract


The subject of this study is to raise a legal controversy about the law that prevails the activity and management of National Oil Companies between the general administrative law and the private commercial law, and the ability to which the shares of these companies can be offered for public subscription under the law governing it, where the National Oil Company is the backbone of the economy of the oil producing countries ,putting it's shares for public subscription leads to it's privatization in whole or in part. As a result of it's transformation from a joint stock company, the State or public legal persons own all it's shares to a commercial joint stock company whose ownership is mixed between public and private persons in varying proportions determined by law, This has to change the law governing the activity of the company and it's relationship with its employees ,from administrative law to commercial law.
