Abstract


The financial dispute between the Kurdistan Regional Government (KRG) and the Federal Government of Iraq represents one of the most intricate, recurrent, and contentious issues in the Iraqi political landscape. It is characterized by a continuous contest between the federal government and the KRG over the allocation and control of financial resources, a conflict that resurfaces with each cycle of drafting and deliberating a new federal budget. This dispute is primarily concerned with the financial entitlements of the Kurdistan Region as stipulated by the Iraqi Constitution and the federal financial management statutes, encompassing the region's share of the national budget, the administration of its oil revenues, and various other fiscal matters. These aspects are governed by the Federal Financial Management Law of Iraq, which establishes the framework for the distribution of financial revenues between the federal government and regional and provincial authorities, with particular emphasis on the rights and obligations of the Kurdistan Region. However, the fiscal relationship between the federal government and the KRG has not been consistently harmonious; it has undergone numerous transformations and faced considerable challenges over time due to unresolved issues concerning oil revenues, customs revenues, and overarching fiscal policies. This study seeks to critically examine and analyze the financial entitlements of the Kurdistan Region within the context of the Federal Financial Management Law. The research adopts a descriptive-analytical methodology to assess the legal, economic, and administrative frameworks, and to evaluate the effectiveness of the existing mechanisms, drawing on data from a variety of sources. The study strongly emphasizes the imperative for unwavering compliance with the provisions outlined in the Iraqi Constitution and the federal financial management legislation by all involved parties, ensuring their uniform enforcement and precluding any potential evasion of their prescribed mandates.
