National security can be maintained and promoted based on several institutions, in which, if they are institutionalized and managed based on constitution and laws, they would become the main factor for safe domestic politics and foreign policy in the light of democracy, freedom and human rights. The researcher of this study investigated the presence of these legal institutions in the Kurdistan Region and how they are managed.
The Kurdistan Region more than any other political entities needs the presence of legal and legitimate institutions due to its political situation in Iraq and in the region. This paper aims to scientifically practice the interdependence of both institutional and national security theories on as a case study, especially the national security of the Kurdistan Region after the decisions of the Iraqi Federal Court and the actions of the Iraqi Federal Government toward the provinces Councils, the Kurdistan parliamentary elections by the Independent High Electoral Commission (IHEC). It also investigates the efforts of the Iraqi government to control the land and airports of the Kurdistan Region. The study highlights the importance of legislative and executive institutions and their role in protecting the national security of the Kurdistan Region.
The findings of the study showed that although the Kurdistan Region has legal and constitutional institutions, the interference of political parties and their leaders in the institutions are the main obstacles to the process of institutionalization and weakness of the institutions. This has created a huge gap between the people and the authorities. For this reason, the institutions of the Kurdistan Region are not up to the level of demand and need to serve the citizens. The Iraqi federal institutions such as the Federal Supreme Court and the Iraqi government have interfered more than their authority in Iraqi constitutions. This has had a negative impact on national security in the Kurdistan Region.
