Abstract


The telecommunication companies might breach their obligations that they bear either legally or consensually within their relations with the customers or the other. This breach will create a civil tort, and mere mistakes do not require civil liability unless it leads to damage to the others, and this could be imagined with the participation of the sim-card holder through using it in a wrong way to call others and threaten them or harass others or similar acts, and this leads to the establishment of a joint liability on both of them. This research addresses the issues that realization of this liability brings, and how to solve them, through explaining the limits of the joint liability and their solidarity towards the infected party.
