Abstract


Research into the legal characterization of public employee performance reports is of fundamental importance in developing and reforming the employment system. Performance reports have numerous implications for employees, including promotion, advancement, annual bonuses, and retention in the job. There is no dispute that the availability of these implications and guarantees for employees in the area of performance evaluation depends on determining the proper legal characterization of the performance report. Therefore, to legally characterize the performance report, one must resort to the standard: the extent of the administrative judiciary's authority to oversee performance evaluation reports. Also, does the public employee's performance report have a legal impact? To answer these questions, this research is divided into two sections. In the first, we examine the development of the legal characterization of the public employee's performance report in administrative jurisprudence. In the second, we address the legal characterization of the public employee's performance report in comparative administrative jurisprudence.
