Abstract


This paper presents the role of police in the early stage of investigation as the most sensitive stage of criminal justice, emphasizing the necessity for a balance between the power of the police to detect crimes and preserve fundamental human rights and freedom.

Moreover, national and international legal texts, judicial decisions and international reports have also been analyzed in a descriptive, analytical and comparative method.

The results indicate that although the law gives the police certain powers, however, in certain cases, there is an expansion of investigations; the police can only investigate in cases of emergency. Thus, the paper emphasizes on developing police’s legal capabilities and awareness.
