Abstract

Economic and social rights are considered the second generation of rights and freedoms that mentioned in international covenants and treaties related to human rights. Despite their importance, the constitutional legislatures of some countries have neglected to provide the fundamental protection necessary to guarantee these rights.

What prompted developed countries to enshrine economic and social rights in their constitutions was a global concern for these rights. States that have ratified the conventions related to these rights are obligated to uphold them, and even those that have not ratified these conventions are bound by them, given that human rights in general constitute a part of public international law, which is binding on all nations.
