Abstract


The crime of kidnapping aggravated with sexual molestation which are characterized as capital crimes, in which individuals highly respect their honor, social reputation and protect them from infringement. In addition, this offense is one of the hated crimes that cause extreme physical and psychological consequences on victims (men or women) and their relatives and the community as well. In this unlawful act, the perpetrator takes victims freedom and life away and keeps her or him hidden from the eyes of the government. By target his malicious motives either by raping her or him, or molesting her. What exacerbates this situation is that the law gives incentive to who kidnaps a victim and gets married with her within a short time. In other words, marriage clears the offender records and the community has no longer power to deter this offense. Finally, by this, the law deprives the victim from the right to free marriage guaranteed by law.
