Abstract


Disciplinary proceedings constitute a legal mechanism aimed at ensuring the proper functioning of public services through holding public employees accountable for acts that breach their official duties. However, such accountability should be exercised within specific time limits in order to achieve legal and functional stability and to protect the employee from remaining indefinitely under the threat of disciplinary prosecution. The research problem lies in the absence of an explicit legislative regulation governing the extinction of disciplinary proceedings by limitation under Iraqi law, unlike certain comparative legislations that have expressly regulated this system, while others have referred its provisions to the general rules of civil law or civil procedure law. The study adopts a comparative analytical approach through examining the positions of French and Egyptian legislation and comparing them with the Iraqi and Kurdistan Region legal frameworks, alongside relevant judicial trends. The research concludes that establishing statutory limitation periods for disciplinary proceedings constitutes a fundamental guarantee for balancing the administration’s interest in holding employees accountable with the employee’s right to legal and occupational stability, thereby necessitating legislative intervention to regulate limitation rules in a clear and explicit manner.
